이전에 사전 안내 드린 내용과 같이, 이번에 개정된 원산지증명서 관련 시행령 및 시행규칙 내용상 FTA 원산지증명서 발급을 위한 기초자료인 원산지확인제도가 도입되어 안내 드리오니 FTA 증명서 발급업무에 활용하시기 바랍니다.
저희 한-베 FTA 활용지원센터는 내수업체로부터 중간생산물품을 공급받아 수출물품 생산하는 업체들이 원산지증명서를 발급함에 있어 필수적으로 요구되는 원산지확인서 제도의 마련을 2017년 중순부터 베트남 산업무역부에 제안하였고, 마침내 해당 제도가 원산지증명서 관련 베트남 시행령 및 시행규칙상 도입되었습니다.
관련 시행령 및 시행규칙상 포함된 규정 및 관련 양식을 참고하시어 향후 FTA 활용에 참고하시기 바랍니다.
□ 관련 규정
1) Decree 31/2018/NĐ-CP Detailing Law on Foreign trade management about goods origin
Article 15. Dossier requesting for C/O issuance
- g) Declaration of origin of the manufacturer or supplier for originating materials or originating goods produced domestically shall be complied with form of the Ministry of Industry and Trade in case such materials are used in next stage of manufacture of other product.
2) Circular 05/2018/TT-BCT Elaboration on Goods Origin
Article 7. Declaration and Commitment to origin of goods
- In case materials or goods (with origin) are domestically produced and used in the next stages for the production of another good, the manufacturer or supplier of the raw materials or goods is responsible for Declaration and Commitment on origin of goods, made according to a form provided in Appendix VIII to this Circular, and supplied to exporters for finalization of dossiers of C/O issuance specified at Point g, Clause 1. Article 15 of Decree No 31/2018ND/CP.
- Forms for Declaration and Commitment of goods origin stated at Points 1,2 and 3 of this Article shall be published electronically on the Ministry of Industry and Trade's electronic certificate management and issuance system at addresses www.ecosys.gov.vn or other websites of C/O issuing agencies, which are authorized by the Ministry of Industry and Trade to facilitate the use of C/O for traders.
